Study on the Supreme Court of the United States from the pragmatic perspective of a judge. The book addresses the problem of democratic legitimacy and its relationship with the Court, through historical examples that document cases in which some decisions have been ignored or disobeyed. The author proposes practical approaches to analyze the law and explain how the legitimacy of the Court should be maintained based on judgments and interpretations that help make the Constitution function when being in practice (or when being executed), a task that requires applying immutable principles to changing circumstances and establishing relationships with other institutions such as the Congress, the Executive Branch, the States of the Federation, the Courts of other jurisdictions and the historic Courts. Finally, the work addresses the challenges that the Supreme Court faces in terms of the protection of individual freedoms.
